Where Does Stupidity End and Criminality Begin?

Republican Senator Ron Johnson tested positive for coronavirus then went to an Oktoberfest Party with thousands of people, infecting an unknown number of people. He refused to wear a mask and just spoke to reporters this morning that he still doesn’t believe in wearing masks. This is the party of pure stupidity and an immediate danger to public safety–this is the Republican Party.
It’s worth noting that Senator Johnson’s state of Wisconsin is now one of the worst COVID hotspots in the entire world) Great work Johnson, great work Republicans, and great work voters of Wisconsin for voting for a guy like this. God bless.
To me, this raises an interesting question: When does stupidity or pathological rigidity in one’s thinking cross a line and become criminality?
When Nazi Adolph Eichmann, one of the major organizers of the Holocaust, was captured and tried after almost 20 years of life in hiding, his principle defense was that his only crime was that he failed to use reason. This didn’t fly, and rightfully, he was hanged.
Lions don’t choose their ends, and thus moral judgments can’t be applied to them. When we say that a lion is “vicious,” we’re actually misusing the term, as lions aren’t capable of vice.
Human beings, on the other hand, don’t have such a defense. We can, and in fact, must use reason in the way we conduct our lives, as Eichmann learned as he climbed the gallows.
